Insurance Information & Coverage

There are many different types of insurance policies available, and it may not be totally clear as to which policies your organization needs. In an effort to assist watershed groups with making decisions about managing their insurance needs, POWR has reviewed some websites and guidance offered by insurance companies.

General Liability Coverage

Here's how one company describes the purpose of a typical general liability policy (please recognize that terms differ from policy to policy and it's critical to be familiar with the particular terms of any policy before deciding that it meets your specific needs) as sustaining a claim by a third party made against your organization for their injury. For example, if an attendee at one of your educational events fell and injured him or herself, the policy would pay to defend your organization against the claim and pay an award if one were made, within the limits of the policy."

POWR's General Liability Insurance Policy runs from April 14 - April 14 of the following year. Any additions to the policy after April 14 will be pro-rated. We are now currently accepting applications to take effect on April 14, 2008.

POWR is offering group general liability coverage to Pennsylvania watershed groups/members. The following is a summary of the service offering and terms.

What: General liability insurance coverage

Who: Any nonprofit Pennsylvania Watershed group that is a member of POWR, and has 501(c)3 status is eligible.

Why: POWR advocates for the protection, restoration and enjoyment of our common wealth of water resources, and conducts programs that foster stewardship, communication, leadership and action. To that end, POWR has conducted a poll of watershed groups to see where we may be of more help to you in being effective watershed stewards. You told us that you needed help getting insurance coverage.

How: POWR has purchased an insurance policy that provides coverage for general liability and allows us to extend the same terms of coverage, through our policy, to our members. When a member purchases coverage, they are "endorsed to" POWR's policy.

Terms of coverage:
• Personal & Advertising Injury: $1,000,000
• Employee Benefits: $1,000,000
• Damage to Rented Property: $100,000

• Liability Umbrella Coverage: $4,000,000
• Aggregate Annual: $6,000,000

This coverage is for the classic "slip-and-fall" injury claims by someone who, for example, attended your organization's educational event. It would also cover claims of libel and slander with respect to publications and press interviews.

What This Does Not Do:
• Replace "Errors & Omissions" or "D&O" policies
• Insure automobiles or watercraft
• Cover, special, on-the-water events such as sojourns or canoe trips
• Workers compensation

Fees: A member of POWR may purchase the general liability coverage for .52 cents per member of your organization, with a minimum of $104, plus POWR's administrative fee of $100. This administrative fee goes to our costs in working with the insurance professionals to develop this program, maintaining records, transmitting payments, and taking on the risk of additional insured since additional covered parties increases the likelihood of claims on POWR's own insurance policy. There is also a $65 fee for the added umbrella coverage.

Conditions: To be eligible to participate, a group must be
• Incorporated PA Nonprofit/501(c)(3)
• Member of POWR
• Watershed Association (or environmental group with watershed protection)

 

Directors & Officers Coverage

The large exposure facing the Directors and Officers of a corporation in their role as corporate managers may well exceed the assets of their Company. For virtually any corporation, the cost of defending suits against its Directors and Officers can prove catastrophic. D & O Liability Insurance helps protect the Directors and Officers of the Company against claims alleging:

  • employee discrimination or unfair employment practices
  • wrongful termination
  • disposal of corporate assets, without regard to the firm's ability to pay for or secure the Company's debts
  • wrongful denial or termination of credit for any customer or client
  • violation of the antitrust laws or unfair methods of competition
  • violation of a loan covenant
  • exorbitant dividend payments or profit sharing contributions which were made by the Company
  • improper loans made to Directors or Officers

POWR does not currently offer joint D&O coverage due to the unique nature of individual policies and coverages.
